VARIANCE REQUEST WORKSHEET


A variance allows the use of property in a manner otherwise forbidden by a zoning ordinance by varying one or more of the performance standards such as lot size, setbacks, etc. Variances from official zoning controls are defined under Minnesota Statutes 394.27 and require the landowner to prove that the property could not otherwise be used or enjoyed in the proposed way by complying with ordinance requirements and that there will be no negative impact on surrounding properties.
It is advisable that you discuss your request with Planning and Community Development staff prior to submitting the application.  Describe what you are varying from and the situation that makes it difficult to comply with county ordinances.
If your proposal includes a structure, please also list the length, width and height of the structure.
Field is required.We are proposing to meet all other standards for set back with the exception to the property line set back on the NE side of the property if facing the lake. The neighboring property is owned by James Golanski. We had our property surveyed in July 2020. We are currently, 5 feet off the property line and proposing to move 10feet off this side of the property line shared with Golanski. This lot is long and narrow starting at 50 feet at the shoreline and expanding out to 79feet at the road (old 77). The building site has a number of precluding barriers that prohibit the size and orientation of the proposed structure. Our holding tank is 10feet from the back of the existing cabin. The holding tank is proposed to be used as part of the design of a new septic tank located by the road. We have applied for this septic permit as of 10126120. We meet the 75feet setback to the high-water mark currently. There is an electrical pole which supplies power to our cabin, Golanski's and the Reed property our neighbors to the left when looking towards the lake. We have had Lake Country Power out three times with consultation on moving this electrical pole. They have not determined a definite alternative to move it and it remains 5 feet away from our proposed corner of the new structure. So, currently moving closer to the Reed property isn't feasible. Furthermore, the Reed residence is on the plane as our current and proposed building, so we want to be careful to give as much birth as possible on the side of the property.  Describe the intended/planned use of the property.
Field is required.We have had a long-term plan to make this property our permanent home since we purchased it in 2007. After a large tree fell on the roof which damaged the roof and foundation in July 2019, our pace and urgency increased. We have until July 2021 to satisfy our insurance claim. We recently sold our family home in the twin cities and want to begin our transition. Our only child started college at UMD. I now working from home and my husband travels for work. I grew up in the area and we have family and friends on the lake and close by. Although we will maintain a small rental property in the cities for a bit, our lake property will be our permanent home. With that said, we have planned a modest, one story, 2-bedroom, 1 bath home. The original cabin built on this property squared out it 25 X 35. It was built in the 1930's we had seriously looked at trying to add an addition, but everyone who looked at the structure did not think this was feasible. We are proposing a 28 X 44 structure.

Field is required.As we have planned for a modest structure like our neighbor's dwellings, we believe it orientates well on the lot and respectful to our neighbors. The upgrade of the building and landscaping should improve our property and positively impact our neighbors. We plan for a classic looking exterior and intend to utilize professional landscaping services.

Field is required.We propose going from 5 feet to 10 feet set back on the Golanski side of the property. We propose maintaining a 20feet setback from Reeds property line because the alignment of our cabins. The Reed side is where the entrance is planned and want to ensure more space is provided for privacy. This would also give the ability to maintain a more balanced green space. We have most of the mature trees on the property on the Reed property line, we have a shared driveway and our beaches connect at the water line. So our natural orientation for a useable yard is on that side of the property. In addition, the Reed cabin is 20feet from the property line and as fore mentioned on the same plane.
 Describe how negative impact to the local environment and landscape will be avoided.
Field is required.We have hired an excavator contractor to provide a water management plan, site prep and some soft berms to provide a backdrop for our landscape structure. The excavator and builder have environmental safeguards cited in the contract in order to proactively manage environmental concerns. This fall we proactively planted some screening plants to further protect our neighbor's views. The neighborhood deer herd promptly stripped the trees and ripped them out of the earth. Our neighbor Mr. Golanski replanted them twice before giving into nature. We will replant more robust screening trees with additional protections.
 Describe the expected benefits of a variance to use of this property.
Field is required.It is no doubt a narrow property. We are suggesting that the plan we are describing provides good stewardship of the land. We are not suggesting coming closer to the water or any other concessions other then reducing our setback on the Golanski side of the property. We were previously approved to build by Greenwood Township Planning and Zoning. We paid our fees and upon a site visit, we were asked to cut back our 1930's-built boathouse that protruded in the water. We cut off 6-7feet off of the boathouse to comply. Upon receiving our approval, this function was moved to St Louis Co. Our permit was considered voided and we had to start over. We are trying to make a livable space that is respectful to our neighbors and fits with the neighborhood. With the many confines of this lot we believe we have made a good faith effort to put forth a plan that takes all these factors into consideration.

We tried to take our neighbors needs and wishes into consideration and worked hard to find the right balance and harmony for the building and the many site confines we are faced while trying to make everything compliant. In our view our plans are simple and not extravagant for a permanent home. This small request of 5feet variance on one side of the property line would make a significant difference.
