A variance allows the use of property in a manner otherwise forbidden by a zoning ordinance by varying one or more of the performance standards such as lot size, setbacks, etc. Variances from official zoning controls are defined under Minnesota Statutes 394.27 and require the landowner to prove that the property could not otherwise be used or enjoyed in the proposed way by complying with ordinance requirements and that there will be no negative impact on surrounding properties.
It is advisable that you discuss your request with Planning and Community Development staff prior to submitting the application.  Describe what you are varying from and the situation that makes it difficult to comply with county ordinances.
If your proposal includes a structure, please also list the length, width and height of the structure.
Field is required.This application requests an after-the-fact variance from shoreland setback and dimensional performance standards to allow existing structures on the property to remain as currently configured, including: 1) an existing pergola addition, 2) an adjacent deck that exceeds the allowable depth, and 3) an existing garage structure with finished living space that is considered a second principal dwelling due to its footprint on a sub-one-acre lot. The property is located in a shoreland area with physical site constraints and a limited lot size that restrict relocation or reconfiguration of these structures. Strict compliance with the ordinance would require removal or substantial modification of improvements that have been in place for several years, resulting in practical difficulties and unnecessary hardship to us without a corresponding public benefit.
 Describe the intended/planned use of the property.
Field is required.Continued residential use as a single-family lakeshore home, with the pergola and deck used for outdoor enjoyment and the garage structure containing finished space used by family members on an occasional basis. No commercial or rental use is proposed.

The garage structure contains finished space with plumbing that has been used by family members on an occasional basis and is not used as a separate or rental dwelling.

Field is required.Alternatives would include removing or substantially modifying the pergola and deck and removing finished living space and plumbing from the garage structure in order to bring the property into compliance. These options would be costly and disruptive and would result in practical difficulties for us, while providing no meaningful public benefit given the long-standing nature of the structures and the lack of impacts. Because the structures are existing, no additional land disturbance is proposed.
 If approved, how will the proposed use, with the variance, fit into the character of the neighborhood/area?
Field is required.Approval of the variance will allow the property to continue to function in a manner consistent with the surrounding area, which consists primarily of single-family lakeshore residences with decks, pergolas, and accessory buildings. The existing structures are residential in nature and are compatible in scale and appearance with neighboring properties, and will not alter the character of the neighborhood.
 Describe how neighboring properties and the use of those properties will be impacted by the proposed use with the variance.

 Describe your reasons county zoning ordinance requirements were not followed.
The improvements occurred over time, and it was not understood that additional permits or variances were required for the pergola, deck depth, and finished space within the garage. At the time of construction, we were not aware that separate land use approvals were necessary for these existing conditions. The work was completed in good faith, without any intent to violate county regulations.
 Describe your effort to comply with the ordinance and to obtain a land use permit and/or other required permits.
Upon receiving notice from the County, we promptly contacted Planning and Zoning staff and are now submitting this application in order to bring the property into compliance and resolve the matter through the variance process.
 Describe any substantial investments, construction and/or repairs made to the property before you discovered you needed a variance.
Substantial investment was made in the construction and ongoing maintenance of the pergola, deck, and finished space within the garage structure over several years, prior to learning that a variance was required. Requiring removal or significant modification of these improvements would result in unnecessary hardship.

 Who performed the construction or repair work?
Construction occurred over time as follows: • Accessory structure/garage: constructed in 2017 (survey completed at that time). • Pergola: added in approximately June 2022 (no survey obtained). • Deck: added in approximately July 2023 (no survey obtained). The work was performed by licensed contractors and, in part, by the property owner.
