VARIANCE REQUEST WORKSHEET


A variance allows the use of property in a manner otherwise forbidden by a zoning ordinance by varying one or more of the performance standards such as lot size, setbacks, etc. Variances from official zoning controls are defined under Minnesota Statutes 394.27 and require the landowner to prove that the property could not otherwise be used or enjoyed in the proposed way by complying with ordinance requirements and that there will be no negative impact on surrounding properties.
It is advisable that you discuss your request with Planning and Community Development staff prior to submitting the application. Approval or denial of your request is dependent on the justification you provide in answering the questions on this application.  Describe what you are varying from and the situation that makes it difficult to comply with county ordinances.
If your proposal includes a structure, please also list the length, width and height of the structure.
Field is required.Relief from Zoning Ordinance 62 Section 6.11 subsection B.2 Max size of accessory dwelling limited to 700 sq ft. Requesting the existing structure of 840 sq ft size with attached garage be assigned as the accessory dwelling allowing our disabled son to remain in a familiar environment and a new home of 1450 sq ft living space under a 1095 sq ft building footprint to be built for parents (caregivers).
 Describe the intended/planned use of the property.
Field is required.Existing structure of 840 sq feet would become the accessory dwelling for our disabled adult son who is 24 years old. He is very familiar and comfortable with the current dwelling. The new home (1450 sq ft living space under a 1095 sq ft building footprint) would allow us, his parents, to remain on the same property and care for his daily living needs.
 Describe the current use of your property.
Field is required.Wehave a 840 sq foot structure with one bedroom/one bathroom that we share with our disabled adult son. Our property consists of almost 8 acres and contains heavily forested portions of land as well as approximately 200 feet of lake shore along a small private wildlife lake (non-recreational). Our son thrives on our property with its abundance of nature and peace, therefore Stacy and our son spend a large amount of the calendar year at this property as it is the best environment for his quality of life, as well as ours, as his caregivers.
 Describe other alternatives, if any.
Field is required.Weattempted to complete a property split that met our zoning district requirements. However during this process, we were informed that due to approximately one of our acres of land being in the lake, and therefore unusable, that a property split would not be allowed
 If approved, how will the proposed use, with the variance, fit into the character of the neighborhood/area?
Field is required.Our neighborhood is primarily single family homes on acreages. Many of the neighboring properties have multiple structures such as detached garages, ADUs, lean-to structures, pole buildings, etc.. Our intended new home will blend in very well with our existing neighborhood properties.
 Describe how neighboring properties and the use of those properties will be impacted by the proposed use with the variance.
Field is required.There will be no impact to neighbors as the property is surrounded by thick forest on three sides and neighbors are unable to see onto our property. From the private access drive the new structure will be directly in front of the existing dwelling therefore the existing dwelling would not be easily noticed.
 Describe how negative impact to the local environment and landscape will be avoided.
Field is required.We do not intend to remove any trees, or as few trees as possible, by developing and building the new house on the existing lawn area.
 Describe the expected benefits of a variance to use of this property.
Field is required.The addition of another house on the property will provide age in place/caregiver facilities on site for not only our family but for future owners as well. For us specifically, this will allow our adult son the dignity and pride of feeling independent in his own home while at the same time providing the safety measures and daily care that he requires to be provided on site by us, his parents/caregivers.
