VARIANCE REQUEST WORKSHEET
A variance allows the use of property in a manner otherwise forbidden by a zoning ordinance by varying one or more of the performance standards such as lot size, setbacks, etc.
Variances from official zoning controls are defined under Minnesota Statutes 394.27 and require the landowner to prove that the property could not otherwise be used or enjoyed in the proposed way by complying with ordinance requirements and that there will be no negative impact on surrounding properties.
It is advisable that you discuss your request with Planning and Community Development staff prior to submitting the application. Approval or denial of your request is dependent on the justification you provide in answering the questions on this application. Describe what you are varying from and the situation that makes it difficult to comply with county ordinances.
If your proposal includes a structure, please also list the length, width and height of the structure.
Varying from the minimum lot size of 9 acres that is required. 5 acres would be a better option for dividing the current parcel up.
Describe the intended/planned use of the property.
Daughter is planning to build a house on the new parcel.

It is only used for recreational use. There are no current structures on the property.

If approved, how will the proposed use, with the variance, fit into the character of the neighborhood/area?
It will allow for another single family home in the neighborhood while also maintaining the rest of the parcel for recreational use.
Describe how neighboring properties and the use of those properties will be impacted by the proposed use with the variance.
Neighboring properties will hardly be impacted as most of the surrounding property around the proposed new parcel is also owned by me. Surrounding properties will be able to be used the same as prior to the variance.
Describe how negative impact to the local environment and landscape will be avoided.
Access to the property is an old logging road, and it has been maintained as such to this day. Therefore, minimal trees and vegetation will be impacted for the driveway. As many trees and vegetation as possible is planned to be kept on the proposed parcel as well.
Describe the expected benefits of a variance to use of this property.
If this new parcel were to ever be sold in the future, only 5 acres would be sold compared to 9 which would only be able to typically hold one home, rather than multiple. This would prevent additional developments from being created in the neighborhood. This variance also allows for the current parcel to be used for both a home as well as recreational use.

I am trying to split up my current parcel in the best way for my family and myself. 5 acres is plenty of room to build a house in this area, and it also keeps my current parcel as intact as possible.
