VARIANCE REQUEST WORKSHEET
A variance allows the use of property in a manner otherwise forbidden by a zoning ordinance by varying one or more of the performance standards such as lot size, setbacks, etc.
Variances from official zoning controls are defined under Minnesota Statutes 394.27 and require the landowner to prove that the property could not otherwise be used or enjoyed in the proposed way by complying with ordinance requirements and that there will be no negative impact on surrounding properties.
It is advisable that you discuss your request with Planning and Community Development staff prior to submitting the application. Variance Request
Describe what you are varying from and the situation that makes it difficult to comply with county ordinances.
If your proposal includes a structure, please also list the length, width and height of the structure.
We are looking to comply with county planning by removing the current nonconforming lake home and build a new home, behind the 50 ft lake set back. However, currently we now use a separate 216 sq ft storage/shop and a 640 sq ft garage. First , we are asking for a variance to remove these two structures and add the storage and garage square footage to the new lake home.
Secondarily, we are asking for a variance as the new lake home ends up with a deck that protrudes into the shore impact zone by 74 square feet, because we are being squeezed between the rock slope behind the house, the 50 ft set back, and enough driveway remaining to turn around.
Describe the intended/planned use of the property.
A family home used both summer and winter. Projected use as a retirement home in the future.

Same. A family lake home

Remodel and repair existing 80 year old nonconforming log home and keep the storage/shop and garage outbuildings.
If approved, how will the proposed use, with the variance, fit into the character of the neighborhood/area?
It will be set back from the lake, with a north woods cabin/lake home appearance with earth tone colors and there will be one structure, not 3 structures.
Describe how neighboring properties and the use of those properties will be impacted by the proposed use with the variance.
Minimal impact. Construction traffic for the period of construction.
Describe how negative impact to the local environment and landscape will be avoided.
-Complete and careful removal of the old log structure
-New landscaping of vacated area with a natural look
-New home using the existing well and relocation of the septic holding tank.
Describe the expected benefits of a variance to use of this property.
1. Moves the house behind the 50 ft set back
2. Combines 3 structures into one and visually reducing the number of buildings.
Include additional comments that will clarify your request for the Planning and Community Development staff members and the Board of Adjustment.
If we can get this variance to combine the three structures it provides for the future a new much improved functional structure for year round sues, is less intrusive visually and it really helps to justify the considerable cost of tear down, new construction and ongoing taxes.
