VARIANCE REQUEST WORKSHEET


A variance allows the use of property in a manner otherwise forbidden by a zoning ordinance by varying one or more of the performance standards such as lot size, setbacks, etc. Variances from official zoning controls are defined under Minnesota Statutes 394.27 and require the landowner to prove that the property could not otherwise be used or enjoyed in the proposed way by complying with ordinance requirements and that there will be no negative impact on surrounding properties.
It is advisable that you discuss your request with Planning and Community Development staff prior to submitting the application. Approval or denial of your request is dependent on the justification you provide in answering the questions on this application.  Describe what you are varying from and the situation that makes it difficult to comply with county ordinances.
If your proposal includes a structure, please also list the length, width and height of the structure.
Field is required.Need to vary from the 100' lake set back to ensure unimpeded access to the garage and maintain use of current well. Complying with the 100' set back creates a distance at the front of the house to the garage of 22' feet, back part of the house covers part of existing driveway making parking of a car in existing garage difficult if not impossible. 75' rather than 100' set back gives us 25' to allow parking in garage. 75' setback also allows for us to continue use of existing well. Lake setback of current house is approx. 50' or less to lake shoreline. House going on the property is a single story home, 52' x 42' facing shoreline, rear of the house is 28' wide. Height of house is ~12'.
 Describe the intended/planned use of the property.
Field is required.Intended use of the new house is for a four season, full time residence, there will be no rental of this house such as VRBO.
 Describe the current use of your property.
Field is required.Currently the property is used as a three season home. It is not capable of four season occupation and must me demolished due to rampant mold and mildew through out the roof, ceiling and walls. Settling of the house has also gravely compromised the foundation.
 Describe other alternatives, if any.
Field is required.Alternatively to my request for 75' shoreline, the new structure could be shifted south. That option would still require 75' shoreline setback and 15' side property set back. Another option ie observing the 100' shoreline setback, with variance request 6' setback on southern side.
 If approved, how will the proposed use, with the variance, fit into the character of the neighborhood/area?
Field is required.If approved this house will fit in with the size, form and character of other houses currently in existence in this general neighborhood. The new, low profile structure set back at 25' feet further from the current house will be more aesthetically pleasing and lessen visual pollution.
 Describe how neighboring properties and the use of those properties will be impacted by the proposed use with the variance.
Field is required.Due to the size of our lot, 1.88 acres, combined with heavily wooded property and placement in very close relation to the current house, I don't believe the new structure negatively impacts the neighboring houses. Rather, the impact should be positive with 25' further set back than current house from the shoreline, combine this with removal of a run down, uninhabitable house and condemned septic system, the impact is positive for the neighborhood.
 Describe how negative impact to the local environment and landscape will be avoided.
Field is required.Negative impact to the local environment will be much lessened due to setting the new house further back from the shoreline than current house. We further avoid environmental impact by replacing a condemned septic system less that 75' from the shoreline to an approved septic system avoiding ground water or lake contamination.
 Describe the expected benefits of a variance to use of this property.
Field is required.Removal of the existing house and septic system and replacing with a new, energy efficient home, with much lower height profile will improve the view of neighbors and view from the water. Personally the variance allows us to have full access to the existing garage and park car, keeping overall lot appearance neater by not crowding house and garage closely together
