VARIANCE REQUEST WORKSHEET


A variance allows the use of property in a manner otherwise forbidden by a zoning ordinance by varying one or more of the performance standards such as lot size, setbacks, etc. Variances from official zoning controls are defined under Minnesota Statutes 394.27 and require the landowner to prove that the property could not otherwise be used or enjoyed in the proposed way by complying with ordinance requirements and that there will be no negative impact on surrounding properties.
It is advisable that you discuss your request with Planning and Community Development staff prior to submitting the application. Approval or denial of your request is dependent on the justification you provide in answering the questions on this application.  Describe what you are varying from and the situation that makes it difficult to comply with county ordinances.
If your proposal includes a structure, please also list the length, width and height of the structure.
Field is required.Requesting 0' setback variance from 66' road right of way for construction of a 32 x 40 garage (1280 sq ft) at a reduced setback. The garage would be 80' from our shoreline AHW. It is 67' from the adjacent neighbors closest AHW. Note: the adjacent neighbor's cabin lies approximately 20' in front of our new proposed garage. The garage will fit in this area with limited elevation/fill needed. Other sites on the property have an elevation slop of 17.5% or would utilize our replacement drain field area and block Lake County Power access to the the power pole in the yard.
 Describe the intended/planned use of the property.
Field is required.Upon completion, future use of the property will be a year round retirement residence for my wife and me. The additional garage space is needed for storage of boats, UTV's,snowmobiles and lawn equipment vs. the unsightly outdoor storage of the items under tarps, etc.
 Describe the current use of your property.
Field is required.Current use is a seasonal cabin of limited size and limited garage/storage space. Property also has a boathouse, sauna and three small accessory buildings. Three accessory buildings will be removed or relocated as part of the project.
 Describe other alternatives, if any.
Field is required.Property does not allow for other alternative locations, due to: a. Space behind existing garage is drain field replacement location and Lake Country Power access to power pole and transformer in our yard. This property lies along a steep hill on the roadway, which would make it unsafe to enter a garage from the middle of the hill, especially in the winter. This location would also require between 2' and 7' of fill to level garage site. b. Most vacant land on our property has an approximate 17.5% slope from drainfield too existing cabin or existing garage and would not be functional for a garage for older people.
 If approved, how will the proposed use, with the variance, fit into the character of the neighborhood/area?
Field is required.Breezy Point Road has a number of year round and seasonal properties. The requested variances will have no negative impacts to the neighborhood. The garage will be setback off the existing road at the greater distance than most garages or residences in close proximity to our property. We would enter garage from our existing driveway, with the exception of one door that would enter off road and only be used to store a boat in the winter. The proposed area for the garage would be aesthetically pleasing in relation to the other structures on ours and the neighbor's properties.
 Describe how neighboring properties and the use of those properties will be impacted by the proposed use with the variance.
Field is required.There will no impact to the use of neighboring properties. New structure will have no impact to access of neighbors to their properties or to the environment. The new garage would be 16 and 20 feet from side property (fire #3392) line, as garage has slight angle following the ROW. and exceeds the side yard setbacks. Placement in this location obtains the maximum distance from neighbors AHW line and exceeds the side yard setbacks.
 Describe how negative impact to the local environment and landscape will be avoided.
Field is required.There will be limited removal of trees for the addition to the new home. Approximately 50 % of the addition location already has a 16 x 12 deck, which will be removed. The location of the garage has mostly "scrub" pine trees and an existing 8 x 12 accessory shed, which will be also be removed for construction. Area for proposed garage has limited slope, plus will utilize the existing driveway and not create additional erosion concerns.
 Describe the expected benefits of a variance to use of this property.
Field is required.The expected benefit will allow building of an "average" size (1,440 sq. ft.) year round home. The granting of the variance to use the existing foundation will cause little disruption to surrounding landscape. The road setback variance will allow construction of the garage with no or limited shoreline setback needed. With the proposed garage location, we meet the 75 ' . shoreline setback (except 67' from neighbors shoreline AHW) and would need a roadway setback no greater than neighbors garages in close proximity. Three small structures would be removed from our property. The placement of the proposed garage would be placed at 0' setback from 66' road right of way. On a practical basis, the road right-of-way adjacent to our property is 66', but would never be developed at that, because the right-of-way tapers to the plotted 33' right-of-way at our adjoining property line.
