VARIANCE REQUEST WORKSHEET


A variance allows the use of property in a manner otherwise forbidden by a zoning ordinance by varying one or more of the performance standards such as lot size, setbacks, etc. Variances from official zoning controls are defined under Minnesota Statutes 394.27 and require the landowner to prove that the property could not otherwise be used or enjoyed in the proposed way by complying with ordinance requirements and that there will be no negative impact on surrounding properties.
It is advisable that you discuss your request with Planning and Community Development staff prior to submitting the application. Approval or denial of your request is dependent on the justification you provide in answering the questions on this application.  Describe what you are varying from and the situation that makes it difficult to comply with county ordinances.
If your proposal includes a structure, please also list the length, width and height of the structure.
Field is required.We purchased our cabin on Whiteface Reservoir in 2024. It was built in 1973 and is a non conforming structure as it sits 80 feet from the lake (on NE side of cabin) so it's within the set back. That side of the cabin does have an existing deck that extends 8' out on the NE side of the cabin (towards the lake). Our intention is tear down that deck and go out 16" from the existing cabin wall on the NE side, therefore we would be protruding an additional 8' from the current footprint (cabin & deck). We would NOT be putting a deck on that side. The cabin is 32' long, 24' deep and 12' tall. The deck extends 8' out from the NE side. The proposed addition would be 16' long, 24' deep and 14' tall. We are varying from the for ordinance listed in "Additions: To Nonconforming Structures in Shoreland Areas" as it states "7. The addition does not decrease the existing shoreline setback. The proposed addition would decrease the current set back by 8' To comply we would either need to build behind the cabin (with no means to enter the structure from the cabin as the bathroom and bedrooms are in the way). The other choice is the opposite side of the cabin, but because the lot slopes away on that end the addition would be higher off the ground and brings concern for the addition shifting with the higher posts. (cabin sits on posts , no foundation) . Also building on this side takes away from the original purpose of having a long view of the lake.
 Describe the intended/planned use of the property.
Field is required.The addition would be a used as a 3 season porch, used to enjoy the full long view of the lake and be protected from mosquitos and horse flies (wife reacts badly to their bites). The NE side of the cabin currently prohibits that view from inside the cabin as the bathroom, kitchen and entrance are on that side, therefore making it prohibitive to enjoy the view from a protected area.
 Describe the current use of your property.
Field is required.We use the cabin as it is, but it restricts how much my wife can enjoy the lake views from the outside.
 Describe other alternatives, if any.
Field is required.An alternative is to build the addition on the opposite side (SW) but it gives a us a restricted view of the lake as there is a shed in the way in addition to the trees and vegetation. Also, that side of the property slopes down therefore making the addition to sit higher off the ground and therefore raising concerns about the stability as the cabin (and addition) sits on posts. Adding a foundation would be cost prohibitive based on the value of the current structure. Also there would be additional costs of moving the current MINI split system that exists on that side of the cabin.
 If approved, how will the proposed use, with the variance, fit into the character of the neighborhood/area?
Field is required.The addition would fit in nicely as it just extends the length of the cabin and not take away from the "resort feeling" we currently have on our part of the lake. No trees would be taken down. Also the current deck is not in good shape and would be need to be replaced if we are not allowed to build the addition. It currently takes away from the aesthetics of the building.
 Describe how neighboring properties and the use of those properties will be impacted by the proposed use with the variance.
Field is required.The structure would fit in nicely as it would match the current pitch of the roof and same depth. We have 2 neighbors, the neighbor to the north has the same view we intend to have, so the addition would not change their view of the lake. The neighbor towards the SW (opposite side) would not even see the addition as it's extending on the side opposite of them. Not to mention we have woods dividing us, so they can't see through our lot as it is.
 Describe how negative impact to the local environment and landscape will be avoided.

Field is required.Be able to enjoy the beauty of the lake and trees, without being exposed to the weather and insects (due to spouses severe allergies)
