VARIANCE REQUEST WORKSHEET


A variance allows the use of property in a manner otherwise forbidden by a zoning ordinance by varying one or more of the performance standards such as lot size, setbacks, etc. Variances from official zoning controls are defined under Minnesota Statutes 394.27 and require the landowner to prove that the property could not otherwise be used or enjoyed in the proposed way by complying with ordinance requirements and that there will be no negative impact on surrounding properties.
It is advisable that you discuss your request with Planning and Community Development staff prior to submitting the application.  Describe what you are varying from and the situation that makes it difficult to comply with county ordinances.

Field is required.I’m requesting a variance due to my non-conforming existing dwelling is within the 100 ft setback and a previous addition has been permitted (attached garage?), as the Land use planner stated. The home was laid out with no “focal front entry point”. Our visitors, package deliveries couldn’t find the front entry door and they all came to our bedroom patio door that faces west towards the driveway/road.
 Describe the intended/planned use of the property.
Field is required.The intent was to have a designated entry to the home, where visitors knew where the front entry door is located. In addition, it adds protection from the elements while exiting or entering the vehicle.
 Describe the current use of your property.
Field is required.Current use is a drive under covered entry.

Field is required.There were no other alternatives since the front entry door was placed on the south side when I purchased the home. Other entries would have been through garage, bedroom or living room.
 If approved, how will the proposed use, with the variance, fit into the character of the neighborhood/area?
Field is required.It would fit in with the character of the area with its matching gable roof lines, pine and cedar construction.
 Describe how neighboring properties and the use of those properties will be impacted by the proposed use with the variance.
Field is required.I believe variance would not be impacted since we are separated by a large wood area to the south and north. The structure is not visible to any neighboring properties.
 Describe how negative impact to the local environment and landscape will be avoided.
Field is required.The impact would be minimal if not zero. The driveway up to the door was already existing and had already been an open area. There is now a greenspace with Ginella Maple trees, and 30 white cedar trees planted around the accessory structure.
 Describe the expected benefits of a variance to use of this property.
Field is required.The benefits of the structure variance: a. We’re able to have a designated entrance to the house that is visible to visitors, deliveries. b. We’re able to use a covered entry to unload vehicles, kids etc. c. It protects us from snow and rain and any trees that could fall towards the house, as we had trees down on house in July 2016 storm. d. Our kids enjoy playing under it and can be outside when it rains.

Field is required.I’m looking to get the after -the -fact variance for this accessory structure so we can continue to enjoy it. We use it every day. It’s farther away from the shoreline setback that the existing dwelling falls within all other setbacks. It was complete ignorance on my part not knowing it needed a permit. I was a first-time home buyer and didn’t know an accessory structure needed a permit if it didn’t have walls or a floor. Our family would love to keep using it as our main entry.

I was under the impression you needed permits for structures with a floor and walls. I didn’t understand this structure was needed since it had neither. I should’ve been more pro-active on knowing the laws as a 1st time home buyer. It was complete ignorance on my part.
 Describe your effort to comply with the ordinance and to obtain a land use permit and/or other required permits.
I have submitted my application for this structure and have been working with the planner.
 Describe any substantial investments, construction and/or repairs made to the property before you discovered you needed a variance.
12. Substantial investments include timber framing, cedar trim, pine tongue and groove, roofing shingles.
