VARIANCE REQUEST WORKSHEET
A variance allows the use of property in a manner otherwise forbidden by a zoning ordinance by varying one or more of the performance standards such as lot size, setbacks, etc.
Variances from official zoning controls are defined under Minnesota Statutes 394.27 and require the landowner to prove that the property could not otherwise be used or enjoyed in the proposed way by complying with ordinance requirements and that there will be no negative impact on surrounding properties.
It is advisable that you discuss your request with Planning and Community Development staff prior to submitting the application. Variance Request
Describe what you are varying from and the situation that makes it difficult to comply with county ordinances.
If your proposal includes a structure, please also list the length, width and height of the structure.
Our variance is for a second principal structure while keeping our existing smaller cabin as a bunkhouse/storage. We cannot change the size of the existing structure to conform and we cannot move existing structure due to huge expanse load to do so.
Describe the intended/planned use of the property.
Our new structure will actually have two bedrooms where our little cabin has none. The new structure will also have indoor plumbing where the little cabin does not. In order to shrink the footprint, we designed garage on bottom and living space above.
Describe the current use of your property.
It serves as a day cabin with a sink that is now attached to the new septic system per new zoning requirements.
Describe other alternatives, if any.
We really wanted to build onto the little cabin but zoning will not allow us to do so. Short of moving to another lake, we don't have any other options.
If approved, how will the proposed use, with the variance, fit into the character of the neighborhood/area?
It will fit well. Both neighbors have nice multiple structures on their properties and ours wouldn't be overwhelming at all.
Describe how neighboring properties and the use of those properties will be impacted by the proposed use with the variance.
There should be no impact whatsoever.
Describe how negative impact to the local environment and landscape will be avoided.
This is exactly why we made certain it was well past the shoreline standards (217 ft. back from lake). Total impervious surface area at less than 15%. Part of current drive will turn back into yard. No gray water issues as we've invested $25,000+ for well and septic system.
Describe the expected benefits of a variance to use of this property.
Out little cabin doesn't have any bedrooms or baths. My wife retires from MN National Guard in 6.5 years and we want to be able to spend a great deal of time up north and be able to have friends stay, something we cannot do now.
Include additional comments that will clarify your request for the Planning and Community Development staff members and the Board of Adjustment.
We have included all setbacks on the septic system (already certified by St. Louis County). We believe we have complied with all building regulations and have acted in good faith throughout this process. Your consideration is greatly appreciated.
