VARIANCE REQUEST WORKSHEET
A variance allows the use of property in a manner otherwise forbidden by a zoning ordinance by varying one or more of the performance standards such as lot size, setbacks, etc.
Variances from official zoning controls are defined under Minnesota Statutes 394.27 and require the landowner to prove that the property could not otherwise be used or enjoyed in the proposed way by complying with ordinance requirements and that there will be no negative impact on surrounding properties.

Variance Request
Describe what you are varying from and the situation that makes it difficult to comply with county ordinances.
If your proposal includes a structure, please also list the length, width and height of the structure.
The homeowners are requesting a variance from the required shoreline setback of 100 ft from Burntside Lake to build a new 1 1/2 story 1,900 square foot cabin to replace an existing 985 square foot substandard cabin that sits 43 feet from the shoreline. The proposed siting of the new cabin would encroach upon the required setback by 52 feet, improving the current nonconformance by 9 feet and take the dwelling out of the Shore Impact Zone. This 292 foot wide lot is characterized by a significant slope which rises 98 feet above the lake level in 500 feet. Approximately 1/2 of the site is in a Bluff Impact Zone. The existing cabin and adjacent outbuildings sit the on flattest area of the site with the cabin situated on a levelled man-made plateau created for its
construction. The existing flat area is approximately 11'-0” above the lake level. The land rises up sharply immediately behind the existing structure and these hills are wooded with several large mature trees. The existing cabin is a single story wood framed structure, with a footprint area of 985 square feet. While the proposed structure is larger, with a 1,590 square foot footprint including the screened-in porch, it is modest in scale according to current building standards. The current structure is approximately 16’-6” tall from grade to the highest point, and the proposed structure is designed to meet the current zoning ordinance height restriction of 25’ with the ridgeline 24’-8” above the lowest point of grade on the lakeside. At its closest point, the existing structure sits 43.9 feet from the shoreline, and as such encroaches on the Shore Impact Zone by 6 feet. The roofline of the proposed structure would be placed outside of the shore impact zone at 50 feet from the shoreline. [SEE ATTACHMENT FOR MORE]
Describe the intended/planned use of the property.
The owners intend to maintain the current residential recreational use which is permitted under the land use ordinance.

The presence of a bluff on the southwest side of the lot prevents positioning the proposed structure further from the shoreline. The location of the existing well and septic lift station also impact the siting of the cabin.
If approved, how will the proposed use, with the variance, fit into the character of the neighborhood/area?
The proposed cabin is modest in scale and fits the size and character of the existing structures on the adjacent properties. The proposed distance of the new cabin from the OHW appears to be further from the lakeshore than
the existing structures on the adjacent property to the south (reference existing survey). The proposed orientation of the new cabin is also more closely aligned with the lakeshore than the existing cabin and thereby more in keeping with the cabins on the adjacent properties. The orientation of the new cabin and its massing are also intended to create a more historically correct visual relationship between it and the other outbuildings on the site.
Describe how neighboring properties and the use of those properties will be impacted by the proposed use with the variance.
The proposed use is the same as the current use. The neighboring properties will not be impacted by the proposed use with the variance.
Describe how negative impact to the local environment and landscape will be avoided.
The proposed location of the new cabin on the existing flat area of the site minimizes impact on the local environment and landscape by minimizing the disturbance of existing soils for excavation. During construction a 3 foot wide by 18” high woodchip berm will be installed for perimeter sediment control. The site immediately adjacent to the new cabin and existing bunkhouse will be lightly graded to better manage surface water drainage. These areas will also be reinforced to manage long term erosion. One mature tree between the existing bunk house and new cabin and several small trees and shrubs will be removed to facilitate re-grading.
Describe the expected benefits of a variance to use of this property.
This projects removes a substandard building and replaces it with a historically sensitive, right-scaled project that sits sensitively on the land and maintains the existing use. While not taking the property out of nonconformity, the proposed project improves the overall property's nonconformity moving the cabin out of the shoreline impact zone and providing ground cover reinforcement to better manage the run-off on the site.
