VARIANCE REQUEST WORKSHEET


A variance allows the use of property in a manner otherwise forbidden by a zoning ordinance by varying one or more of the performance standards such as lot size, setbacks, etc. Variances from official zoning controls are defined under Minnesota Statutes 394.27 and require the landowner to prove that the property could not otherwise be used or enjoyed in the proposed way by complying with ordinance requirements and that there will be no negative impact on surrounding properties.
It is advisable that you discuss your request with Planning and Community Development staff prior to submitting the application. Approval or denial of your request is dependent on the justification you provide in answering the questions on this application.  Describe what you are varying from and the situation that makes it difficult to comply with county ordinances.
If your proposal includes a structure, please also list the length, width and height of the structure.
Field is required.We are proposing a 40' wide by 58' long by 27' -2" Tall, 3 bedroom dwelling including an attached garage replacing an existing 2 bedroom 14' by 56' non-conforming mobile home with a 144-sf entry. Current side property setbacks of 8' to the West and 9' to the East. The proposed dwelling will have a side property setback of 12' on the NW corner and SE corner. The building will have the same orientation as the old building (just pushed back approx. 8') to achieve the 100' shoreline setback while stopping short of building over the well on the roadside (North) of proposed building.

Field is required.House orientation/views will remain similar to neighboring structures. Colors will be earthtone and blend in with surrounding structures. Dwelling will be used as a single family residence.

Field is required.Property to the East is a MN Power access property leased by Michael Flatley. Set back to the West side neighbor will be improved by nearly 4'.
 Describe how negative impact to the local environment and landscape will be avoided.
Field is required.The structure will be entirely earth tone colors. Structure storm water runoff will not directly discharge into the lake or neighboring properties. Dwelling has a St. Louis County compliant sewage treatment system. Demolition will be disposed of in a manor acceptable to St. Louis County. State, local and federal requirements will be met.

Field is required.Will be able to achieve the 100' shoreline setback. Maintain the current lakeview orientation while keeping a similar layout as other neighboring structures. Only the 40' width of the structure will be facing the lakeshore with this layout.

The structure we are proposing is a modest home and will improve on the current setbacks in place. We can improve on the side property setback from 8' and 9' to 12'' on both sides and achieve the 100' shoreline setback. We are limited to the north because of the existing well
