Upstairs Bathroom in Building. The property currently has a 2000 Gallon holding tank. A new septic system and mound will be installed this spring prior to the building the structure.. This will be done by Low Impact Excavators from Ely, MN.

A variance allows the use of property in a manner otherwise forbidden by a zoning ordinance by varying one or more of the performance standards such as lot size, setbacks, etc. Variances from official zoning controls are defined under Minnesota Statutes 394.27 and require the landowner to prove that the property could not otherwise be used or enjoyed in the proposed way by complying with ordinance requirements and that there will be no negative impact on surrounding properties.
It is advisable that you discuss your request with Planning and Community Development staff prior to submitting the application.  Describe what you are varying from and the situation that makes it difficult to comply with county ordinances.
If your proposal includes a structure, please also list the length, width and height of the structure.
Field is required.Variance on the setback (85' vs 48') from County Road 88. It is a garage with loft that will be 20 feet x 32 feet x 20 feet high. These dimentions have been revised from original Land Use Application ID 23--000026 to meet the county standards.
 Describe the intended/planned use of the property.
Field is required.Heated garage for Cars, boat, tools etc. on the lake side of CY88. Upstairs living area for guests and relaxation. There is not room for the 85' setback.
 Describe the current use of your property.
Field is required.Currently there is a 750 square foot cabin the we added heat, insulation and new windows to be used year round.
 Describe other alternatives, if any.
Field is required.It would not be feasible to build a garage on the other side of CY88. The excavation costs would make this far too expensive because of a Hill. Also having to cross CY88 all the time would be difficult.
 If approved, how will the proposed use, with the variance, fit into the character of the neighborhood/area?
Field is required.The lot is quite wooded. The siding and roof colors will match the current cabin. The neighbors will not be able to see the structure.
 Describe how neighboring properties and the use of those properties will be impacted by the proposed use with the variance.
Field is required.There will not be impact from neighbors. If you look at Google earth, you will see the neighbors are a good distance away.
 Describe how negative impact to the local environment and landscape will be avoided.
Field is required.Again, I don't see any negativity. We will be planting more trees on the road side and lake side of structure.
 Describe the expected benefits of a variance to use of this property.
Field is required.The cabin is small with no closed bedrooms. Having visitors is very difficult for privacy. This structure will allow us to entertain and have place for others to sleep. Not to mention the benefit of the garage close to the cabin.

Field is required.Originally I was told by a surveyor that the setback was 48' which made all fit. I submitted the plot with the original land use permit. Obviously, he or I was not familiar with a "Collection Road". I discussed my needs for a garage with both the realtor and the surveyor prior to buying. This is when I received the plot drawing and proceeded with the purchase. So you can imagine our dissapointment to do all we've done and now this. I honestly don't see any negative impact. Especially comparing to Boathouse regulations of 10 to 25 feet from the lake. What's interesting is nobody ever heard of a "Collection" road. Not the realtor, surveyor or builders. I also could not find anything on the county website that explains or identifies "collection" roads. Also, most of the current structures on CY88 are very close to the road, many closer than 48 feet. In fact, a log cabing just built this fall probably does not even meet the 48" setback. Also, the speed limit on the road by our property is 30 mph. I believe all things considered, there would not be any reason to not allow this request. Thank you!
