VARIANCE REQUEST WORKSHEET


A variance allows the use of property in a manner otherwise forbidden by a zoning ordinance by varying one or more of the performance standards such as lot size, setbacks, etc. Variances from official zoning controls are defined under Minnesota Statutes 394.27 and require the landowner to prove that the property could not otherwise be used or enjoyed in the proposed way by complying with ordinance requirements and that there will be no negative impact on surrounding properties.
It is advisable that you discuss your request with Planning and Community Development staff prior to submitting the application.  Describe what you are varying from and the situation that makes it difficult to comply with county ordinances.
If your proposal includes a structure, please also list the length, width and height of the structure.
Field is required.I am requesting a variance on the road setback form my property for the purposes of building a garage. I own a narrow lot (132 feet from edge of the read to the shoreline), as classified by St. Louis for property tax purposes, which makes it difficult to meet both setback requirements. With the variance proposed, the lake shoreline setback is still able to be met. If both setbacks (road at 48 feet from center of road, lake at 75 feet) were used without this variance, that would only leave 17 feet for a garage.
 Describe the intended/planned use of the property.
Field is required.My family currently uses this property as a seasonal cabin. My wife and I plan to move here as full time St. Louis County residents in the future and this garage is the beginning of our plan for the property. Our next project plan is to build a year round home on this property as wee, so having a two car garage is an important part of the future plan. This garage will be used to store our boat, snowmobiles and other items and eventually be used to park vehicles in when we live up here in the winter months.
 Describe the current use of your property.
Field is required.This is a seasonal cabin property that is used by my family.

Field is required.I don't see any alternatives for building a two-car garage on this narrow lot without a variance.
 If approved, how will the proposed use, with the variance, fit into the character of the neighborhood/area?
Field is required.If approved, this garage will add a cleaner look to our property. All items that we store outside will be moved into this garage, so the yard will have less clutter. When this is built, I will remove an old shed that is crooked and in poor repair so that will also add a better look to the neighborhood as well. There are several other garages on Birch Point Road that are much closer tot he road than I ma requesting, so it will not look out of character for the area. Earth tone colors will be used to match our cabin so this will match the style we currently have, consistent with other homes and cabins in the neighborhood. There is still a row of trees/brush for 12-18 feet between this and the road so a buffer will be maintained so as to blend in our property.
 Describe how neighboring properties and the use of those properties will be impacted by the proposed use with the variance.
Field is required.there should be no impact to any of the neighboring properties if the variance is approved and the proposed garage is build. The property behind the proposed garage area has a fence, so it is an area that is not used for anything now. I have spoken with all of neighbors about my plan and no concerns have been raised.
 Describe how negative impact to the local environment and landscape will be avoided.
Field is required.There should be no negative impact to the local environment because of this request. Since a driveway and wide access to the property already exists, no changes to the landscape will be necessary for this project.
 Describe the expected benefits of a variance to use of this property.
Field is required.There are several benefits that are expected if this variance is approved: clean and tidy property appearance., removal of old shed, increased property value, ability to store more snowmobiles/ATV's for fall and winder outdoor activities, increased property value, increased property tax collection for St. Louis County and the ability to keep my boat and other belongings in from the elements.

Field is required.I am requesting a 10 foot and 6 foot variance from the centerline setback on my road to build a garage. I believe this is reasonable and not out of character for my neighborhood. Given the narrow lot that this is being proposed on, I respectfully request that the board consider this variance request. Thank you.
