VARIANCE REQUEST WORKSHEET


A variance allows the use of property in a manner otherwise forbidden by a zoning ordinance by varying one or more of the performance standards such as lot size, setbacks, etc. Variances from official zoning controls are defined under Minnesota Statutes 394.27 and require the landowner to prove that the property could not otherwise be used or enjoyed in the proposed way by complying with ordinance requirements and that there will be no negative impact on surrounding properties.
It is advisable that you discuss your request with Planning and Community Development staff prior to submitting the application.  Describe what you are varying from and the situation that makes it difficult to comply with county ordinances.
If your proposal includes a structure, please also list the length, width and height of the structure.
Field is required.We are seeking a variance from the 100' setback because we want to maintain the historic placement of the cabin and avoid removing an excessive number of trees, more than 20, if we were to over the cabin back. Additionally, we would have to reroute the Lake County Power underground electrical distribution line that served our portion of the lake and move the shed. These types of additional costs would prevent us from proceeding to construct a basement, improve the cabin, and remodel the inside.
 Describe the intended/planned use of the property.
Field is required.The intended use is to remain a family cabin which has been for the past 51 years when my parents purchased the land and built the cabin. Our goal is to upgrade and remodel the cabin so our three children can enjoy the lake and all it has to offer for the next generation and those that follow.

Field is required.It has been a seasonal family cabin since it was constructed by my parents 51 years ago. Our intention is not deviate from that use.

 If approved, how will the proposed use, with the variance, fit into the character of the neighborhood/area?
Field is required.It would continue to blend in as it has all this time. The cabin is green color, the white trim, and a good portion of it shielded from the view from the lake, as shown in the pictures. The cabin will be raised about 5' to prevent any moisture problems in the basement, with the intent to stay above the static water level. The foundation will be backfilled and clad in material that blends in with the surroundings. The basement windows will allow natural light to fill the basement and have land scape rocks placed to avoid erosion. The front of the cabin will have a walk out basement facing the lake. This proposed look and character fits in with the neighboring homes and cabins.
 Describe how neighboring properties and the use of those properties will be impacted by the proposed use with the variance.
Field is required.We intend to stay within our current footprint, other than an 8' x 6' addition on the front to accommodate a staircase, so our impact on neighboring properties will be having to look at the cabin 5' higher. The current front porch being enclosed to allow more year round indoor living space. There will be no impact on the neighboring parties. We are all spaced 100 plus feet from each other and no structure on the lot impose on the neighbors, nor will it take away from anyone's view of the lake and forested surroundings.
 Describe how negative impact to the local environment and landscape will be avoided.
Field is required.During excavation and construction, in the short term, a silt fence will be used to retain the soil from eroding and getting into either the lake or neighboring yards. honestly, we are at the low point between the neighbors, so the soil will not go anywhere. Upon completion, final grading will be carried out and we will plant Norway and birch trees in the yard to replace as many as possible that were removed. We intend to use off peak electric heating with a propone back up. The carbon emissions from electricity and propose exhaust will be the only negative environmental impact.
 Describe the expected benefits of a variance to use of this property.
Field is required.Benefits include: * Maintain proximity to the lake * Increasing interior space from 624 sq. feet to 1696 square feet *Remodeling and updating the interior space and function from the early 70's to today * Provide a long-term upgrade that will last for a few generations.
 Include additional comments that will clarify your request for the Planning and Community Development staff members and the Board of Adjustment.

I did check other properties on the lake as well as in the Side Lake area and do see a track record of approving these types of requests. Certainly, I'll address any questions during the hearing. I appreciate the Board of Adjustments taking this request up.
