VARIANCE REQUEST WORKSHEET
A variance allows the use of property in a manner otherwise forbidden by a zoning ordinance by varying one or more of the performance standards such as lot size, setbacks, etc.
Variances from official zoning controls are defined under Minnesota Statutes 394.27 and require the landowner to prove that the property could not otherwise be used or enjoyed in the proposed way by complying with ordinance requirements and that there will be no negative impact on surrounding properties.
It is advisable that you discuss your request with Planning and Community Development staff prior to submitting the application. Variance Request
Describe what you are varying from and the situation that makes it difficult to comply with county ordinances.
If your proposal includes a structure, please also list the length, width and height of the structure.
We are requesting a variance to the 150' setback. Our lot is pie shaped and the area beyond the 150' setback does not allow an adequate place to build an accessory bldg. due to existing septic, garage, driveway and parking.
Describe the intended/planned use of the property.
We would like to build an accessory bldg. (bunkhouse) 16 x 26 with a screened area 10 x 18 for a total of 596 sq. ft. to be used by our grandchildren and their parents.
Describe the current use of your property.
The current use is residential. We live on the property.
Describe other alternatives, if any.
We have looked at all alternatives. Looked at building a second level on the garage. Structurally, the garage won't support a second floor. Would need to tear down a perfectly good garage (13-14 yrs. old), pour a new slab and build. Way too expensive.
If approved, how will the proposed use, with the variance, fit into the character of the neighborhood/area?
We believe the addition of a bunkhouse will fit the character of the area. It will additionally be nearly unseen by anyone on the lake because of the slope of the bluff and the existing vegetation.
Describe how neighboring properties and the use of those properties will be impacted by the proposed use with the variance.
There are an adequate number of trees buffering between our proposed bunkhouse and Susan and Gary Gasele. There are no other neighbors that could see the bunkhouse accessory bldg.
Describe how negative impact to the local environment and landscape will be avoided.
No trees will need to be removed. Very little impact to the lot. Slope in this location is slightly away from the lake.
Describe the expected benefits of a variance to use of this property.
Increase real estate tax revenue.
Need to upgrade septic to accommodate 3 bedroom at a cost of $11,000.
Benefit to our family lake experience.
Include additional comments that will clarify your request for the Planning and Community Development staff members and the Board of Adjustment.
1. MN Power has rezoned lot line to accommodate 10 ft. property line setback already. 2. Neighbors are ok with bunkhouse. 3. Will add vegetation to further buffer visuals from lake. 4. Will remove an after-the-fact granted variance (July 2017) for pump/boathouse if necessary to balance variance use for this property (& add vegetation to area).
