VARIANCE REQUEST WORKSHEET
A variance allows the use of property in a manner otherwise forbidden by a zoning ordinance by varying one or more of the performance standards such as lot size, setbacks, etc.
Variances from official zoning controls are defined under Minnesota Statutes 394.27 and require the landowner to prove that the property could not otherwise be used or enjoyed in the proposed way by complying with ordinance requirements and that there will be no negative impact on surrounding properties.
It is advisable that you discuss your request with Planning and Community Development staff prior to submitting the application. Variance Request
Describe what you are varying from and the situation that makes it difficult to comply with county ordinances.
If your proposal includes a structure, please also list the length, width and height of the structure.
We are asking to have the 15-foot setback rule be adjusted by 4 feet on each side with the setback to be 11 feet. This would still meet the performance standard of 10 feet. We plan to exceed the requirement of the 75-foot shoreline setback rule as we're planning on building 100 feet from the shoreline.
Describe the intended/planned use of the property.
We plan to build a cabin that could be used year-round.
Describe the current use of your property.
There were 5 structures that we tore down back in February, 2018. They were: a boathouse next to the shoreline, a 20'x30' cabin, a screen house that had a stone fireplace, and an outhouse. By removing these 5 structures we want to only replace the cabin.
Describe other alternatives, if any.
In talking with your office (Jenny Bourbonais) it doesn't look like there are any alternatives due to the width and length of the property (50' x 544').
If approved, how will the proposed use, with the variance, fit into the character of the neighborhood/area?
In looking at most structures on Shady Lane, it seems that they currently have 30-foot widths. The permanent house next to us owned by LeRoy Larson is 30 foot on a 50-foot lot. The cabin on the other side of us owned by Keith and Beth Kirkland is 30-foot on a 50-foot lot. We would rather have our cabin be 28 feet in width and only have a second story structure instead of having it narrow and having to go up to the 35-foot height rule.
Describe how neighboring properties and the use of those properties will be impacted by the proposed use with the variance.
We don't feel that our 28-foot cabin would negatively impact surrounding properties, as they are larger than what we're requesting.
Describe how negative impact to the local environment and landscape will be avoided.
We plan to have the cabin set back 100 feet (shoreline setback rule), which is more than requested by your office. We also plan to use neutral colors/earth tones for the coloring of our cabin, windows, doors, trim and roof. We feel that we have already improved the environment by removing the boathouse that was next to the shoreline, removing a dilapidated screen house and single stall garage on the property, as well as removing the outhouse that was on the property.
Describe the expected benefits of a variance to use of this property.
By receiving the variance and being able to construct a 28-foot width cabin, this will eliminate the need to reach the 35-foot height rule. We want to blend in to our environment rather than stick out because of height.
Include additional comments that will clarify your request for the Planning and Community Development staff members and the Board of Adjustment.
We would like to reiterate that we took down 5 structures on the lot and only plan to replace one of them - the cabin. We feel that we are adding to the beauty of the land because of eliminating structures as well as giving us more landscaping opportunities.
