VARIANCE REQUEST WORKSHEET


A variance allows the use of property in a manner otherwise forbidden by a zoning ordinance by varying one or more of the performance standards such as lot size, setbacks, etc. Variances from official zoning controls are defined under Minnesota Statutes 394.27 and require the landowner to prove that the property could not otherwise be used or enjoyed in the proposed way by complying with ordinance requirements and that there will be no negative impact on surrounding properties.
It is advisable that you discuss your request with Planning and Community Development staff prior to submitting the application. Approval or denial of your request is dependent on the justification you provide in answering the questions on this application.  Describe what you are varying from and the situation that makes it difficult to comply with county ordinances.
If your proposal includes a structure, please also list the length, width and height of the structure.
Field is required.A. We are proposing to add an accessory dwelling unit to an existing property with an existing non-conforming single-family structure built in 1975. The property is less than 1 acre; approximately 3/4 acres. B. We are asking to increase the maximum square footage and maximum height in reference to St. Louis County zoning ordinance section 6.11.C; Accessory dwellings on shoreland areas less than one acre in size. The existing 2-bedroom structure straddles the lakeshore setback by approximately 3.5 feet to 18 feet and a side setback by approximately 5.5 feet. C. We are looking to increase the size of the existing 1,280 sq ft cabin to better accommodate a growing family and to better suit a modern home. The expansion will meet all required zoning setbacks and requirements. D. The proposal requests to increase the maximum 250 square feet to 640 square feet and the maximum height of 14 feet to 27 feet, 23 feet at the roof. Maximum length is 32 feet and maximum width is 20 feet.
 Describe the intended/planned use of the property.
Field is required.The goal for the property is to be a full-time residence. But to better accommodate full-time use the existing cabin needs additional space to support a growing family. The current cabin has only two bedrooms, a single bathroom and small kitchen. The plan is to expand with additional bedrooms and supporting spaces, as well as, at a future date, remodel the existing kitchen.
 Describe the current use of your property.
Field is required.The current use of the property is a short-term vacation home / cabin. Even the use as a short-term vacation home still would benefit greatly with additional space and accommodations to better serve a growing family.
 Describe other alternatives, if any.
Field is required.To allow for more square footage and height we could consider this expansion an addition vs an accessory dwelling. But with an addition connected to the existing structure we run into other zoning issues. Particularly with the frontage issue in section 4.3.D.3. We would exceed the maximum 40 feet with approximately 62 feet or more in order to connect to the existing structure. Additionally, to allow an addition to functionally work we would still need to request additional square footage. If the lot was 1 acre or more than we could potentially not need to request a variance for an accessory dwelling.
 If approved, how will the proposed use, with the variance, fit into the character of the neighborhood/area?
Field is required.The intent of the design is to keep the footprint on the site to a minimum. This is the reason for the 2-story design. This helps the added structure appear smaller in scale and not sprawl across the lot. It also keeps more views of the lake by allowing site lines between the existing and new structures. The overall size of the existing and proposed expansion would be similar in overall square footage to neighboring properties in the area.
 Describe how neighboring properties and the use of those properties will be impacted by the proposed use with the variance.
Field is required.The proposed addition is within allowed building setbacks from all lot lines, road, wetlands and shorelines. Any and all encroachments will conform with current zoning codes. The size of the proposed accessory dwelling including the existing structure is less than or equal to neighboring single-family dwellings and does not obstruct or harm views of the surrounding environment.
 Describe how negative impact to the local environment and landscape will be avoided.
Field is required.The proposed design is meant to minimize disturbance to the site through a small footprint and its effect on any views to and from the lake shore. It minimizes the need for removal of landscaping and trees. The project will include the introduction of additional plantings to offset what disturbances result from the expansion.
 Describe the expected benefits of a variance to use of this property.
Field is required.The proposed expansion will allow for full time use of the property by the owner and any future owner.
 Include additional comments that will clarify your request for the Planning and Community Development staff members and the Board of Adjustment.
