VARIANCE REQUEST WORKSHEET


A variance allows the use of property in a manner otherwise forbidden by a zoning ordinance by varying one or more of the performance standards such as lot size, setbacks, etc. Variances from official zoning controls are defined under Minnesota Statutes 394.27 and require the landowner to prove that the property could not otherwise be used or enjoyed in the proposed way by complying with ordinance requirements and that there will be no negative impact on surrounding properties.
It is advisable that you discuss your request with Planning and Community Development staff prior to submitting the application.  Describe what you are varying from and the situation that makes it difficult to comply with county ordinances.

Field is required.Applying for height variance for a home located within the Shore Impact Zone on Whiteface Reservoir. Also, for a variance to being not in compliance with the requirement of earth tone colors, which pertains not to the structure itself which is cedar tone, but to the trim and roof, as they are currently red. Difficulty is due to the fact we have started the project and have made a significant investment to improve and better the property.

Field is required.We do not believe it will impact the neighboring properties in any way. We have contacted nine of our neighbors up and down the shore, to inquire if any have any objection at all to what our intentions are with the addition. There were no objections whatsoever, but rather, many complimentary comments, particularly the red trim and roof.

Field is required.An erosion control plan to include installation of gutters on all eaves, downspouts that connect to drain piping directed to a collection area approximately 37' downgrade to the northwest, away from the back of the cabin and about 106' feet from the shoreline.

Field is required.A beautiful exterior appearance, as well as, more interior living space, without increasing the building footprint or, encroaching further toward the shoreline.

Field is required.We are very regretful that we did not obtain a building permit in a timely fashion, and subsequently address the need for a variance up front. We are ready to work with Planning and Community Development Department to mitigate issues that have arisen from exceeding the height allowed.

 Describe your reasons county zoning ordinance requirements were not followed.
It was a huge mistake to fail to obtain a building permit (or Land Use Permit) prior to starting on this project. In the past, when we wanted to make improvements to the property, we have first obtained permission from Minnesota Power and then went through the permitting process. We followed those requirements for the construction of a 24' x 32' garage, as well as, when we raised our home (which had been on blocks) and construct a permanent foundation (copies of those permits are attached). So, we are very aware of the rules, but in this case, forgot them in our excitement to finally resolve all of the water leakage issues and space problems that we have been struggling with for some time. This project will give us larger rooms downstairs and better use of all of the space within the footprint. Our intent is to move two very small two bedrooms on the lower level to the dormer in the in the second story. In the process, remodeling so the space now used by two bedrooms on the lower level will allow us to enlarge both the kitchen and dining areas, add a stairway, create a small utility room to house the washer and dryer, make our home more livable and very likely increase the building value at the same time. By not increasing the number of bedrooms, we will remain in compliance with our septic permit (copy attached).
