VARIANCE REQUEST WORKSHEET
A variance allows the use of property in a manner otherwise forbidden by a zoning ordinance by varying one or more of the performance standards such as lot size, setbacks, etc.
Variances from official zoning controls are defined under Minnesota Statutes 394.27 and require the landowner to prove that the property could not otherwise be used or enjoyed in the proposed way by complying with ordinance requirements and that there will be no negative impact on surrounding properties.
It is advisable that you discuss your request with Planning and Community Development staff prior to submitting the application. Variance Request
Describe what you are varying from and the situation that makes it difficult to comply with county ordinances.
If your proposal includes a structure, please also list the length, width and height of the structure.
We are varying from "Ordinance 62, Article VI, Section 6.5, which states that parking areas shall not be placed within shore impact zones. The shore impact zone on Lake Vermilion is 50 feet." Due to the size of our property and the amount of vehicles and trailers our employees and guests bring on site, we need to be able to park within the shore impact zone. Our property is not wide enough to allow parking for up to 40 vehicles and trailers, unless we are able to park within the shore impact zone. Also, during the off-season, we need the parking space for our Houseboats on land. The previous owners have been parking within the shore impact zone for many years and this issue was not addressed with the building permit variance, which included a professional site plan showing "proposed gravel" for parking and driving within the shore impact zone.

The intended/planned use of the property will be as it has been for over 30 years: operation of a houseboat rental fleet and residential home.

I see no other alternatives to be able to fit all vehicles on-site.

If approved, the character of the neighborhood would not change. As I mentioned, the previous owners have been parking within the shore impact zone for many years, as well as the right-of-way, which we are not allowing!

Neighboring properties, as well as their use, will not be impacted by this variance.

As requested by St. Louis County Planning and Development, we have removed previously installed shoreline rock and replaced with a 10-foot wide shoreline vegetation buffer strip with silt fence and straw wattles for erosion control.
Describe the expected benefits of a variance to use of this property.
The benefits of this variance would allow us enough legal on-site parking for our employees and guests while still allowing us to do our everyday work without restrictions of vehicles blocking our movement.

We are simply asking to be able to operate our business under the same conditions and enforced regulations as the previous owners of 30 plus years!
