VARIANCE REQUEST WORKSHEET
A variance allows the use of property in a manner otherwise forbidden by a zoning ordinance by varying one or more of the performance standards such as lot size, setbacks, etc.
Variances from official zoning controls are defined under Minnesota Statutes 394.27 and require the landowner to prove that the property could not otherwise be used or enjoyed in the proposed way by complying with ordinance requirements and that there will be no negative impact on surrounding properties.
It is advisable that you discuss your request with Planning and Community Development staff prior to submitting the application. Describe what you are varying from and the situation that makes it difficult to comply with county ordinances.
If your proposal includes a structure, please also list the length, width and height of the structure.
Varying from the St. Louis County Zoning Ordinance 62 in regards to requesting an addition to a structure that is located within 25 feet and the shore impact zone that is greater than 200 square feet and 25 feet in height. We are requesting that the addition add up to 512 square feet and up to 35' in height. We will be adding up to 175 square feet of deck that will not be uncovered along with a loft that will be up to 392 square feet. We feel that we cannot meet the ordinance requirements (move back from the shore impact zone) due to constraints with parcel boundaries, septic system, access road, terrain, and common areas (water treatment) that prevent us from conforming to the ordinance.

If approved, how will the proposed use, with the variance, fit into the character of the neighborhood/area?
We feel that if the variance is approved and when completed the character of our cabin will conform to the other structures within the Rocky Point CIC (10519, 10525, 10528, 10530 and 10532 Bittersweet lane) as well as other cabins/vacation homes on Lake Kabetogama (i.e size, space, style, and having earthtone colors as not to impede on the natural beauty of Voyagers National Park).
Describe how neighboring properties and the use of those properties will be impacted by the proposed use with the variance.
We feel that the neighboring properties will not be impacted by the proposed use with the variance. There are no units or neighbors behind us that would be impacted by the increase in height nor do we feel the use of their properties would be impacted or impeded by the larger footprint.
Describe how negative impact to the local environment and landscape will be avoided.
We will work with the selected contractor to ensure that the proper storm water controls are in place during the construction of the addition and the landscape is restored post construction to equal or better standards.
Describe the expected benefits of a variance to use of this property.
We look to improve the overall functionality, health and enjoyment of our property and feel that the variance will allow us to address key issues that we have been dealing with; such as crawlspace (moisture issues), plumbing (pipes freezing during the winter periods), furnace (moisture leading to premature failures and potential molding), and minimal square footage to accommodate two bedrooms and people. We feel that the increase in length, width and height will allow us to create more space to bring the furnace inside to the unit rather than below in the crawl space to improve overall health. At this time we'll address the plumbing issues by redesigning the
plumbing within the new floorplan. Pouring a concrete foundation to prevent the ground water runoff from entering the crawlspace which has been impacting the internals of the cabin.

To summarize we feel that the proposed variance would provide a great benefit to our property and cannot meet the ordinance
requirements (move back from the shore impact zone) due to constraints with parcel boundaries, septic, access/entrance road, terrain, and common areas (water treatment) that prevent us from conforming to the ordinance. We feel that the variance request will allow us to have a property similar to other Rocky Point CIC units in both square footage, design functionality, and looks. We feel that it would provide a great improvement to the Rocky Point CIC property. We'll take the necessary precautions to prevent any negative impacts to the environment during it's construction and will restore the landscape once completed.
