VARIANCE WORKSHEET

Enter Variance information. About SSTS Variances Pursuant to Ordinance 61, Article V, Section 3.0 A property owner may request a variance from the standards specified in the Ordinance pursuant to county policies and procedures. Variances shall only be permitted when they are in harmony with the general purposes and intent of this Ordinance where there are practical difficulties or particular hardship in meeting the strict letter of this Ordinance, excluding the technical standards. Certain deviations may require the approval of the MPCA or the MN Department of Health.
 
 Describe the specific provision(s) in the ordinance from which the variance is requested.
 
Field is required.We respectfully request a reduction in the required setbacks between the septic and pump tanks and both the structure and property boundary. Per Ordinance 61, the minimum required setback is 10 feet. We are requesting a variance to allow a 5-foot setback from both the structure and the property line. The existing septic tank is located approximately 6 feet from the garage and 17 feet from the property boundary. We are requesting the 5-foot setback variance to allow flexibility during installation, particularly if excavation conditions prove challenging. The property boundary has been professionally surveyed and marked with pink ribbon to clearly identify setback distances during construction and inspection.
 Describe the practical difficulty that prevents compliance with the rule.
 
Field is required.The tanks were originally proposed to be installed south of the garage, which would have met the required 10-foot setbacks. However, during excavation, bedrock was encountered at shallow depths (approximately 1–3 feet). Multiple test pits were dug in this area, all of which confirmed the presence of shallow bedrock south of the garage. Installing the tanks in this area would require blasting, which is not only cost-prohibitive but could damage nearby structures. This site constraint represents a practical difficulty as defined by the Ordinance. Given the existing topography and subsurface conditions, there is no feasible way to meet the required setbacks.
 Describe the alternative measures that will be taken to achieve a comparable degree of compliance with the purposes and intent of the applicable provisions.
 
We propose to place the tanks in the existing tank basin, which reduces the chance blasting will be required to install the tanks. This location: • Maintains compliance with required setbacks to Lake Vermilion and all wells. • Ensures that the intent of the ordinance—protection of water resources and public health—is upheld. • Preserves the integrity and performance of the system by avoiding installation challenges that may compromise the tanks’ placement or function. This solution represents the least-impact alternative while still upholding the intent of Ordinance 61.
 Identify cost considerations preventing reasonable use of the property under the terms of this ordinance
 
Field is required.Without this variance, the only viable installation area would require rock blasting, which introduces significant financial burden and the risk of structural damage to nearby buildings. In contrast, the proposed tank location reduces both cost and construction risk. Furthermore, the existing septic system is non-compliant, and installation of the new tanks in the proposed location would bring the system into full compliance with current regulations (excluding the reduced structure/property line setback), offering a net public benefit.

VARIANCE AGREEMENT

By submitting this request for variance from the Ordinance and the Construction Standards, I certify and agree that no substantial health hazard is likely to occur therefrom and an unnecessary hardship might result in strict compliance with the Ordinance and Standards.
I further agree to install a sewage treatment system in accordance with the permit application, plans, and specification that are made as part of this variance request, in addition to paying the Variance Fee associated with this request.

I further certify and agree that I will comply with all conditions imposed in connection with the approval of the application. Applicants may be required to submit additional property descriptions, property surveys, site plans, building plans, and other information before the application is accepted or approved. Intentional or unintentional falsification of this application or any attachments thereto will make the application, any approval of the application and any result invalid. I authorize St. Louis County staff to inspect the property to review the application and for compliance inspections.
