VARIANCE REQUEST WORKSHEET
A variance allows the use of property in a manner otherwise forbidden by a zoning ordinance by varying one or more of the performance standards such as lot size, setbacks, etc.
Variances from official zoning controls are defined under Minnesota Statutes 394.27 and require the landowner to prove that the property could not otherwise be used or enjoyed in the proposed way by complying with ordinance requirements and that there will be no negative impact on surrounding properties.
It is advisable that you discuss your request with Planning and Community Development staff prior to submitting the application. Describe what you are varying from and the situation that makes it difficult to comply with county ordinances.
If your proposal includes a structure, please also list the length, width and height of the structure.
The new setback of 48 feet from the center line of the local road would require the garage (14x22x14H) to move 20 feet toward the main dwelling. It has previously been attempted to crack, break, or move the 8'Lx8'Wx5'H boulder that protrudes from the earth (directly between the garage and main dwelling), without success. Therefore, attempting to move the existing structure 20'' toward the existing dwelling and avoiding the unmovable boulder, sets the structure in a place 35' closer to the existing dwelling, and as a result of this proposal, the garage would no longer be accessible by car, as the indestructible boulder would block the entry.
Describe the intended/planned use of the property.
The proposed garage, same size, same footprint, would be used to store one vehicle, boxes of seasonal items, a work/repair counter, and a myriad of tools such as shovels for snow removal and lawnmowers, as this is our primary residence.

If approved, how will the proposed use, with the variance, fit into the character of the neighborhood/area?
Because our neighbors next door as well as many others along this local road have garages, drain fields, campers, etc. close to the road, the proposed and existing garage is well within the character of the area.
Describe how neighboring properties and the use of those properties will be impacted by the proposed use with the variance.
There will be no difference to the impact neighboring properties or their use by the proposed structure as it simply replaces the existing garage within the same footprint and size.
Describe how negative impact to the local environment and landscape will be avoided.
There will be no negative impact to the local environment or landscape as the proposal is to replace the existing garage within the same footprint and the same size.
Describe the expected benefits of a variance to use of this property.
The expected benefits are to improve the overall quality and safety of the structure as there is no record of the date of origin. This will have a visual impact as well.
Include additional comments that will clarify your request for the Planning and Community Development staff members and the Board of Adjustment.
Please allow us to replace the existing leaking garage with an updated version that will function with the benefits of modern technology (update the electrical, replace the garage door so that it seals shut), replace the existing floor to a solid floor that does not allow water to enter, to provide a more visually appealing and functioning exterior, replace the existing window to one that allows light to enter, to replace the man door so that it closes properly and seals to the foundation, and to improve the overall safety of the building to prevent it from being a fire hazard.
