A variance allows the use of property in a manner otherwise forbidden by a zoning ordinance by varying one or more of the performance standards such as lot size, setbacks, etc.
Variances from official zoning controls are defined under Minnesota Statutes 394.27 and require the landowner to prove that the property could not otherwise be used or enjoyed in the proposed way by complying with ordinance requirements and that there will be no negative impact on surrounding properties.

Describe what you are varying from and the situation that makes it difficult to comply with county ordinances.
If your proposal includes a structure, please also list the length, width and height of the structure.
Our existing dwelling is currently a nonconforming structure because it does not meet the required lake setback of 75 feet. It is approximately 50'. (See site detail) The existing structure is a 12-month cabin that we would like to convert to our permanent home. The topography of the lot does not readily allow for replacing the structure in a different location--our only viable option is to expand the back of the structure--away from the lake by 12' in its existing width of 26'. (312 sq ft total) The final structure would not be any closer to the lake--only expanded out the back. The final structure would be 26' wide by 46' deep and 26' high.

Existing topography of lot does not allow for replacing existing struction in a location farther from the lake. Lowering the dimensions of the addition to 200 sq. feet for a performance standard permit would not allow for sufficient Bedroom, Closet, or Kitchen space in the addition.
If approved, how will the proposed use, with the variance, fit into the character of the neighborhood/area?
The character of the bay is very important to us. The North bay of Sturgeon Lake already contains several other non-conforming structures less than 75' from the lake--all of which look attractive and contribute to the character of the neighborhood. This addition will not change the character of the area, but instead, keep in alignment and appearance with already existing structures. With the construction being at the back of the structure, this addition will not significantly impact the appearance of the home from the lake, other than the change to the roof line and newer attractive windows. In addition, this project will upgrade windows / siding / roof, to the general upkeep / appearance of the area. We will continue to utilize only basic natural colors in keeping with the character of the neighborhood.
Describe how neighboring properties and the use of those properties will be impacted by the proposed use with the variance.
There should be no impact upon neighboring properties. The North bay of Sturgeon Lake already contains several other non-conforming structures less than 75' from the lake. As the addition is on the side of the building away from the lake, the view of and from neighboring homes will not be impacted.
Describe how negative impact to the local environment and landscape will be avoided.
The area for the proposed addition is a flat, unlandscaped area. The addition will include an improvement in landscaping around the building. There will be no negative impact on the envisonment or lanscaping.
Describe the expected benefits of a variance to use of this property.
Upgrading the property from a secondary residence to our 12-month permanent home. Bedroom, Bath and Kitchen space will be improved. Overall appearance of property will be improved.

It has been our life-long dream to reside on the Sturgeon Lake chain. We purchased this property in 2014 with the intention of eventually moving out to it permanently. This 12x26 addition would bring the Kitchen / Bedroom / and Bathroom space to a level to make that a reality. We love the Side Lake area, and consider ourselves to be responsible citizens of the community who would never do anything to negatively change its character or beauty. We want to improve our property and neighborhood.
